Colorado Home Services Warranty Statement

Colorado Home Cooling, a division of Colorado Home Services ("CHS"), is committed to providing high-quality service and lasting value to our customers. This warranty statement outlines the terms and conditions of our One-Year Labor Warranty and Five-Year Workmanship Warranty for paid services rendered and paid for after the effective date above.

One-Year Labor Warranty:
CHS warrants that for one year from the date of service completion, we will repair or replace, at our sole discretion, any materials or labor found to be defective due to our installation. This warranty covers the cost of labor to rectify the issue, but does not include the cost of replacement materials. All products sold by CHS carry a parts warranty of one year or greater, and processing a parts warranty on items sold to the customer is covered under our labor warranty.

Examples of CHS services covered under this warranty are:

Re-installing a QuietCool whole-house fan if it malfunctions due to faulty initial installation (e.g., incorrect mounting, improper wiring).

Re-sealing or adjusting a VELUX skylight if it experiences unwanted moisture penetration due to faulty installation (e.g., improper flashing, incorrect sealant application).

Re-wiring or fixing electrical connections if problems occur due to faulty initial work (e.g., loose connections, incorrect wire gauge).

Examples not covered under this warranty are:

Normal wear and tear of materials.
-
Customer-provided products that fail for reasons unrelated to installation.

Damage caused by external factors such as storms, vandalism, or animal activity.
-
Defects in materials provided by the customer.

Issues arising from misuse or improper maintenance by the customer.
-
Service calls for troubleshooting or adjustments not related to faulty installation, such as customer preferences or issues outside our scope.

Issues arising from customer requests against our recommendation.

Five-Year Workmanship Warranty:
CHS further warrants that for five years from the date of service completion, our work will be free from defects in workmanship and construction techniques. This warranty covers the cost of both labor and replacement materials necessary to repair any such defects in our scope alone.
Examples of CHS services covered under this warranty are:

Repairing unwanted moisture penetration in a skylight installation caused by inadequate flashing or poor roof penetration, beyond initial faulty installation.

Fixing electrical resulting from inadequate grounding due to our design or planning.
-
Addressing issues in attic ventilation systems installed or modified by CHS, if caused by improper construction techniques.

Examples not covered under this warranty are:

Issues arising from normal settling or movement of the structure.

Damage caused by external factors such as storms, vandalism, or animal activity.
-
Defects in materials provided by the customer.

Issues arising from actions of other contractors.
-
Issues arising from misuse or improper maintenance by the customer.
-
Service calls for troubleshooting or adjustments not related to faulty workmanship or construction techniques.
-
Issues arising from customer requests against our recommendation.

Important Notes:
-
This warranty is non-transferable and applies only to the original owner of the property where the service was performed for whom the work was invoiced.

This warranty is null and void if the homeowner or another contractor has altered our work or replaced associated materials, compromising the workmanship quality, such as roof replacement, changes to an electrical circuit, changes to ventilation, etc.

To make a warranty claim, please contact CHS. We will need to verify the date of service and the nature of the issue.

CHS reserves the right to inspect the affected area before authorizing any repairs under this warranty.

This warranty is in addition to and does not affect any other rights or remedies that you may have under applicable law.

Please note: Some manufacturers may have longer and more extensive warranty requirements for their products used in our installations (ie. VELUX 10-year No-Leak Guarantee). If you have any questions about manufacturer warranties, please do not hesitate to ask us for more information.

Addition 1 October, 2022:
CHS does not accept credit card payments for invoices in excess of $5,000. Cash, checks and direct deposit payments are accepted.

Addition 6 January, 2021:
CHS offers incentives to all customers who complete successful customer referrals. Referral incentives vary based on the products and services provided. Past QuietCool (QC) customers will receive $150 back for every successful referral while referred QC customers will receive $50 off their installation. Non QC customers will receive $75 back for every successful referral while the referred customers will receive $50 off their installation. Past VELUX customers will receive $25 back for each product installed during a successful VELUX referral while the referred customer will receive $25 off every product installed. No limits apply to the number of customer referrals made. Referral offers cannot be combined and are subject to change based on requirements from our manufacturers. Referring customer's name must be provided during the estimation process and confirmed prior to scheduling the install to receive cash back. Cash back will not be added day of install.

Addition 1 August, 2021:
CHS may offer seasonal discounts to all new and returning customers. All CHS Discounts are subject to change. Discounts cannot be combined with CHS Cash Back Referral program. Seasonal discounts may be combined with other incentive programs at CHS sole discretion. Discounts must be provided during the estimation process and confirmed prior to scheduling the install to be applied. Discounts will not be added day of install.

Addition 1 October, 2021:
CHS accepts returns of unused and undamaged products from the online store for full refund or exchange within 15 days of the original purchase. Items received after 15 days of the original purchase are not eligible for a full refund. Customer is responsible for additional shipping and handling fees for returned or exchanged items. CHS is unable to provide return shipping labels at this time. Refund and exchange requests must be sent to CHS by phone or via email at team@cohomecooling.com and include the associated order number.

Addition 1 October 2020:
VELUX Sun Tunnel installation and skylight replacement labor is warrantied for 5 years from the date of installation. Any damage to VELUX equipment from improper installation, including accelerated wear and tear to the customer's purchase will be replaced at no charge. Warranty is non-transferrable and only valid for the original purchaser and homeowner.

Addition 21 December, 2020:
By requesting quotes, services, or purchasing products from CHS the customer agrees to allow their phone number, email, and/or home address to be used for communication purposes including but not limited to customer followups, product and service announcements. CHS does not sell or share any personal contact information collected from customers with other parties.

Colorado Home Services (CHS) recommends the best products and services to be used, but it is ultimately the customer’s decision as to what and where items are installed in the home.

Approved quotes are not binding, but customers have a 72 hour window to cancel any approved quote/contract and final scope and permission to conduct work on that scope are solidified day of installation.

Payment is due upon the completion of the work as outlined in this invoice. If payment has not been received within 30 days from the date of completion, CHS is entitled to a service charge of 3% per month on the delinquent payment(s).

By requesting quotes, services, or purchasing products from CHS the customer has agreed to allow their phone number, email, and/or home address to be used for communication purposes including but not limited to customer followups, product and service announcements. CHS does not share any personal contact information collected from customers.

The customer has hired CHS to conduct installation in their place, and therefore gives CHS permission to modify the existing home appearance, roof, electrical system and structure in the home, and the customer is accepting responsibility for work completed and local government requirements.

CHS is not responsible for pre-existing conditions arising from work done by the homeowner or other outside companies.

The installed fan may have an unguarded impeller (fan blades). Keep people and animals away from the fan when in operation, as serious injury can occur from contact with a spinning blade.

The customer understands that adequate intake openings and attic ventilation must be provided for the fan to work efficiently and quietly.

CHS provides a 1 year limited warranty on the work accomplished by CHS. Product warranties are held by the manufacturers of these products and subject to their terms. Any changes to the installed whole house fan system or installation will void the CHS and product warranties.

DETAILS
Colorado Home Services Service Agreement Terms and Conditions
Overview
This invoice serves as a contract, and constitutes the entire agreement for work accomplished by Colorado Home Services (CHS) at the home address specified on this invoice. The objects itemized in this document include all products and services that were discussed by the customer and CHS and decided upon by the customer. CHS recommends the best products and services to be used, but it is ultimately the customer’s decision as to what and where items are installed in the home. Payment is due upon the completion of the work as outlined in this invoice.
Payment
Once this invoice is signed, the agreed-upon work is completed, and payment is received, this sale is considered final. There are no outstanding items or services owed to the customer by CHS. If the customer breaches this contract and does not pay the full amount outlined in this invoice, CHS is entitled to damages amounting to the total amount of this contract plus any losses or damages sustained by CHS as a result of non-payment. If payment has not been received within 30 days from the date of completion, CHS is entitled to assess a service charge of 3% per month on the delinquent payment(s). If legal action becomes necessary, the customer is responsible for all court costs and attorney fees.
Installation
The customer gives CHS permission to modify the existing home appearance, roof, electrical system and structure in the home in order to install the whole house / attic fan system in accordance with manufacturer specifications. The customer is responsible for acquiring any documents that may be required by any HOA, government agency or city department, prior to CHS beginning work in the customer’s home. As the homeowner, the customer has hired CHS to conduct installation in their place and is accepting responsibility for work completed and local government requirements. It is the customer’s responsibility to provide a safe and accessible work area and to move personal items away from the installation area before work begins. CHS is not responsible for damage to materials or valuables in the customer’s home, or for additional costs or problems arising from work done or changes made by the homeowner or other outside companies. It is understood that CHS occasionally finds pre-existing problems in the roof, electrical system, and framing in the homes of our customers. While we may make an effort to rectify these problems for the customer, it is understood that CHS is not responsible for these pre-existing conditions.
Product and Safety
The customer understands that the installed fan may have an unguarded impeller (fan blades). Keep people and animals away from the fan when in operation, as serious injury can occur from contact with a spinning blade. It may be necessary to purchase an insulated cover for the fan shutter/grill in order to insulate against cold and to keep louver doors from opening and closing on extremely windy days. If cover/insert is in place the customer must ensure that it is removed before the fan is switched on. The customer understands that adequate openings for intake must be provided in the form of open windows and doors to the outside when running the fan. Failure to provide adequate intake openings may result in backdrafting combustion appliances that are located in the conditioned space of the home. Similarly, adequate attic ventilation is required for the fan to work efficiently and quietly. CHS is not liable for any damage caused by improper use of products and services. Failure to remove insulated shutter/grill covers, inadequate ventilation, or modifications to attic ventilation once the system is installed can compromise the unit and void manufacturer warranties.
Warranty
CHS provides a 1 year limited warranty on the work accomplished by CHS. Any changes to the installed whole house fan system or installation, including but not limited to roofing, ventilation, electrical, framing and drywall by anyone other than CHS employees, will void the CHS and product warranties. CHS reserves the right to schedule warranty work at its discretion. For customers who live outside the Denver Metro Area (as defined by the C-470 loop), CHS may assess a trip charge for warranty work. CHS may assess a charge for service calls even if no substantial work is completed. CHS does not provide any warranties on the products that it sells. These warranties are held by the manufacturers of these products and subject to their terms. CHS, without assuming responsibility for the product warranty, may coordinate with these manufacturers as needed to resolve problems on behalf of the customer.
